Terms of Service

1. Agreement to these terms

By creating an account or using MotaTrack ("the Service", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and MotaTrack, governed by the laws of England and Wales.

2. What MotaTrack is

MotaTrack is a manual-entry vehicle expense tracking tool. It allows you to:

• Add vehicles and log expenses, fuel entries, and odometer readings
• View dashboards and reports on running costs and fuel economy
• Set reminders for MOT, tax, insurance, servicing, and other events
• Export your data in CSV or JSON format
• Use an AI assistant to ask questions about your own vehicle data

MotaTrack does not provide financial advice, vehicle valuations, or insurance guidance. All figures are based solely on the data you enter. We make no warranty as to accuracy.

3. Eligibility

You must be at least 18 years old to use MotaTrack. By creating an account you confirm that you meet this requirement and that you have the legal capacity to enter into this agreement.

4. Your account

You are responsible for:

• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately at privacy@motatrack.com if you believe your account has been compromised

You may not share your account with other people or create accounts on behalf of others without their consent.

5. Acceptable use

You agree not to use MotaTrack to:

• Attempt to access another user's data
• Reverse engineer, scrape, or probe the Service
• Upload malicious files or attempt to compromise system security
• Use the Service for any unlawful purpose
• Misrepresent your identity or vehicle information for fraudulent purposes

We reserve the right to suspend or terminate accounts that breach these conditions without notice.

6. Your data

You own your data. We process it only to provide the Service as described in our Privacy Policy. We do not sell your data or use it for advertising.

You can download all your data or delete your account at any time from Settings. Account deletion is immediate and permanent.

7. File uploads

You may upload receipt images and other files. By uploading files you confirm that:

• You have the right to upload and store the file
• The file does not contain malware, illegal content, or content that infringes third-party rights

We reserve the right to remove files that violate these conditions.

8. Service availability

We aim to keep MotaTrack available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control. We will give advance notice of planned downtime where possible.

We reserve the right to modify or discontinue any part of the Service with reasonable notice.

9. Limitation of liability

MotaTrack is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, MotaTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, missed reminders, or inaccurate cost calculations.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

10. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you have statutory rights to bring proceedings in another jurisdiction.
